This application for anticipatory bail arises out of Gogri P.S. Case No. 251 of 2019, G.R. No. 2213 of 2019, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act.
On perusal of the FIR, it appears that there is allegation against co-accused Gourav Yadav, Raj Kumar Yadav and Heera Kumar Yadav of having opened fire aiming at the informant, who sustained fire-arm injuries. It is alleged against the petitioner that when the informant started fleeing away, the petitioner and co-accused Bijo Yadav attempted to catch hold of him.
Patna High Court CR. MISC. No.82948 of 2019(3) dt.24-06-2020 2/2 Considering the nature of allegation against this petitioner, as mentioned in the FIR, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in Gogri P.S. Case No. 251 of 2019, G.R. No. 2213 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
