JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Chapra Rail P.S. Case No. 67 of 2018, registered for offences punishable under Sections 382 and 307 of the Indian Penal Code.
Allegation as per F.I.R. is of snatching the purse of the sister of the informant, which contained gold chain, ring, cash, cosmetic items, PAN Card, Aadhar Card, Driving License, ATM Card, Cheque Book and Passbook. Petitioner is not named in the F.I.R. Later on, during search a mobile phone without Sim Card has been recovered from the possession of the petitioner, which is said to be of the sister of the informant. It further appears that petitioner is accused in one more case.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in
Patna High Court Cr.Misc. No.67161 of 2018(2) dt.27-11-2018 2/2 judicial custody since 23.07.2018.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Saran at Chapra, in connection with Chapra Rail P.S. Case No. 67 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
