The petitioner seeks regular bail in connection with Sonpur Rai P.S.Case No.140 of 2018 registered for offences punishable under Sections 8, 20, 22 of the NDPS Act. Allegation against the petitioner is about recovery of 12 kg. of Ganja from the bag of the petitioner. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, as the bag is not of the petitioner. He has no criminal antecedent and even the recovered article is less than the commercial quantity. He is in custody for 3 months.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above
Patna High Court Cr.Misc. No.70527 of 2018(3) dt.18-12-2018 2/2 named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Saran at Chapra in connection with Sonpur Rail P.S.Case No.140 of 2018 arising out of NDPS Case No.22 of 2018..
With the aforesaid observation, this application is allowed.
