====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Koransarai (Buxar) P.S. Case No. 101 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018. In the written report it is alleged that recovery of foreign liquor has been made from pick-up van. It is further alleged that persons sitting in the pick-up van have succeeded in running away. They were speaking the name of this petitioner.
Counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 28.9.2018. There is no recovery from his possession. Counsel for the petitioner further
Patna High Court Cr.Misc. No.69718 of 2018(2) dt.27-11-2018 2/2 submits that police has arrested the petitioner merely on suspicion.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Special Judge (Excise), Buxar, in connection with Koransarai (Buxar) P.S. Case No. 101 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
