The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. The petitioner is in custody since 16.06.2017. Earlier prayer was refused on 03.01.2018 in Cr. Misc. No.55357 of 2018. Report of the learned trial Judge reveals that only I.O. of the case is yet to be examined in this case. Submission of the learned counsel for the petitioner is that the informant who is father of the deceased has already been examined as P.W.5 and he has not supported, in his

No.73931 of 2018(3) dt.27-03-2019 2/2 evidence, the allegation of demand of dowry and torture for the same; rather in the cross-examination admitted that the victim was happy with the petitioner. Contention is that the statement of the informant does not show involvement of the petitioner in the crime alleged.

Considering the facts aforesaid and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Suryagadha P.S. Case No.131 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
