====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2018 Heard Sri Sanjeev Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 24-09-2018 in Mahkar P.S. Case No. 176 of 2018 registered for offence under Sections 3,5 and 18 of Bihar State Mahua Flower Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner has falsely been made accused on an allegation of recovery of Mahua Flower from the house of the petitioner. After lodging of the present case, the police has also filed a separate case under Section 7 of the Essential Commodities Act.
Considering the nature of accusation as well as period of custody, let the petitioner, namely, Manish Sao be enlarged on
Patna High Court Cr.Misc. No.70358 of 2018(2) dt.03-12-2018 2/2 bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court, Gaya in connection with Mahkar P.S. Case No. 176 of 2018.
