JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks bail in connection with Ara Town P.S.Case No. 419 of 2018 registered under Sections 380, 411 and 457 of the Indian Penal Code .

Allegation against the petitioner is of commission of theft in the house of the informant. It appears from the impugned order that there is recovery from the house of the petitioner. It also appears that petitioner is accused in nine other cases of similar nature.

Submission of learned counsel for the petitioner is that recovered articles were not put on Test Identification Parade and the same was also not recovered from the house of the petitioner rather from a rented portion of his house and he is in custody for more than four months.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.73981 of 2018(2) dt.17-12-2018 2/2 circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioner. However, trial court is directed to expedite the trial and try to conclude the same within a period of six months.
