====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rail Bhagalpur (G.R.) P.S. Case No. 208 of 2017 instituted for the offence under Section 379 of the Indian Penal Code.
Counsel for the petitioner submits that there is no recovery from possession of the petitioner. Petitioner has not been put on Test Identification Parade.
In the written report it is alleged that while the informant was coming to Bhagalpur and train stopped at Shiv Narayanpur Railway station, the informant was talking with his Mobile sitting near window side. In the meantime, his Mobile phone was snatched by unknown person. The informant jumped from the train and person concerned was chased, but he
Patna High Court Cr.Misc. No.72070 of 2018(2) dt.05-12-2018 2/2 managed to run away. The informant further alleged that during search he was informed by one person that Md. Idris and Md. Chand are involved in committing pick-pocket in that area. As such, mere suspicion has been raised by the informant against the petitioner.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Bhagalpur, in connection with Rail Bhagalpur (G.R.) P.S. Case No. 208 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
