Petitioner seeks bail in Sohsarai P.S. Case No.172 of 2018 instituted for the offence under Section(s) 414 Indian Penal Code.

Counsel for the petitioner submits that from the seizure list it appears that motorcycle has not been recovered from conscious possession of the petitioner. Seizure list is part of the First Information Report, wherein, it is mentioned that motorcycle has been recovered from Rahui-Lohagani road. There is no recovery from possession of the petitioner. Petitioner is painter by profession. He has been implicated in this case merely on suspicion.

Petitioner is in custody since 28.08.2018 having clean

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Sohsarai P.S.
