2. In this present case, the petitioner seeks bail in connection with Runnisaidpur P.S. Case No. 280 of 2024 registered on 04.08.2024 for the offences under Sections 103(1),238 and 3(5) of the B.N.S.

3. As per prosecution case, married daughter of the informant was forcibly kept by co-accused Shashi Kapoor Jha and the informant alleged that co-accused persons along with petitioner stabbed his daughter to death and disposed of the dead body.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The informant is not an eye-

The date of occurrence is 31.07.2024 but the FIR has been registered on 04.08.2024 and there is no explanation for the delay. Specific allegation of committing murder is against coaccused Shashi Kapoor Jha and Sachin Kumar Jha and the petitioner has no concern with those co-accused persons. The name of the petitioner was dragged in this case merely because the fact that the petitioner went to the hospital where the deceased was taken by the other co-accused persons for treatment. Petitioner is having antecedent of three cases and he is on bail in all such cases. Petitioner is in custody since 05.08.2024 and charge-sheet has been submitted.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner. Learned APP submits that petitioner and other co-accused persons committed murder of the daughter of the informant.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the non-specific and vague nature of allegation against the petitioner and also considering the period of custody of the petitioner coupled with submission of charge-sheet, the petitioner above named is directed to be released on bail on

No.559 of 2025(3) dt.22-03-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/concerned court in connection with Runnisaidpur P.S. Case No. 280 of 2024, subject to the conditions mentioned in Section 437(3) of the Code of Criminal Procedure and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
