The petitioner seeks regular bail in connection with Chhatapur P.S. Case No. 254 of 2019 for the offence registered under Sections 147, 148, 149, 341, 323, 307, 354A and 379 of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the son and husband of the informant as also the informant.

The learned counsel for the petitioner has submitted that a bare perusal of the FIR would show that there is no allegation of any sort of specific overt act as against the petitioner herein and he has been falsely implicated in the present case. It is further submitted that though the petitioner is

Patna High Court CR. MISC. No.82209 of 2019(2) dt.11-12-2019 2/2 accused in one other case but he is on bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 14.09.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Chhatapur P.S. Case No. 254 of 2019.
