The petitioner seeks bail in Barh P. S. Case No. 368/18 instituted for the offence under Section(s) 363 and 366A Indian Penal Code.
The informant has alleged that this petitioner has induced her daughter for the purpose of marriage. The victim girl has given her statement U/s 164 Cr.P.C. which is annexed as Annexure-2 to the bail petition, wherein, she has stated her age to be 15 years whereas the Court has assessed her age as 17 years. The victim girl, in her statement, has stated that she was in love with this petitioner and went voluntarily with him to Bakhtiyarpur and lived with him for one day. Patna High Court Cr.Misc. No.77259 of 2018(2) dt.21-12-2018 2/2 medical report of the victim girl is annexed as Annexure-3 to the bail petition, wherein, the doctor has found her age to be approximately 18 years.
The petitioner is in custody since 1.10.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Barh Patna, in connection with Barh P.
