The petitioner seeks bail in connection with Kanti P.S. Case No.802 of 2019 registered under Sections 393 and 506 of the Indian Penal Code besides Section 37 (c) of the Bihar Prohibition and Excise Act, 2016 The accusation is that one Scorpio vehicle came at the petrol pump, where the informant was doing the job of Nozle man. On the direction of the driver, he filled up the diesel in the Scorpio vehicle of Rs.1440/-. When the informant made demand of money, then the persons, who were sitting on the Scorpio vehicle, started to abuse him and came out from the vehicle and on the point of pistol started to snatch the money

On the alarm being raised by the informant, other employees of the petrol pump reached there but two persons, who were in possession of pistol, succeeded to flee away, while the driver and three other persons were apprehended, who disclosed their name as Ankit Kumar, Ajay Kumar Mishra, Ajay Kumar and the driver Ram Pukar Sahni (petitioner). All were in drunken state.

Learned counsel appearing on behalf of the petitioner submits that the petitioner, who is the driver of the Scorpio vehicle, has falsely been implicated in this case. The petitioner has no criminal antecedent and is in custody since 28.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur, in connection with Kanti P.S.
