The petitioner seeks anticipatory bail in connection with Nath Nagar (Lalmatiya) PS case no. 510 of 2017 dated 15.9.2017 registered for the offences punishable under Sections 366(A)/120(B) of the Indian Penal Code.
The allegation is regarding the accused persons having kidnapped the victim girl.
The learned counsel for the petitioner submits that the victim girl in her statement under Section 164 Cr. P.C. has disclosed that she was kidnapped by one Abid and taken to Delhi, however, no physical relation was established by anyone with her and subsequently, Delhi police had apprehended the victim girl as well
Patna High Court Cr.Misc. No.1468 of 2018 (3) dt.12-02-2018 2/2 as the said Abid. In such view of the matter, it is submitted that the petitioner has no complicity in the matter.
Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar (Lalmatia) PS case no. 510 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
