The petitioner seeks bail in a case registered under Sections 147, 148, 149, 224, 225, 307, 353 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner and 20-25 unknown miscreants started indiscriminate firing upon the police party and fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.3.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per F.I.R., there is allegation of firing, but no injury has been caused to anyone.

Patna High Court CR. MISC. No.82864 of 2019(2) dt.13-12-2019 2/2 F.I.R. was instituted against five named persons and 20-25 unknown persons. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Satish Mani Tripathi, learned Judicial Magistrate, 1st class, Khagaria in connection with Gogari P.S. case No.124 of 2015 corresponding to G.R. No.774 of 2015.
