The petitioners apprehend their arrest in connection with Udwant Nagar P.S. Case No. 341 of 2017 registered under Section 30(A) of Bihar Prohibition and Excise Act-2016 of the Indian Penal Code.

The informant alleged that on information, he went by the side of the river but the petitioners fled away after leaving the bag containing country made liquor.

Learned counsel for the petitioners submits that on account of enmity, the name of the petitioner has been mentioned in the F.I.R., nothing has been recovered from possession of the petitioners. Nobody has seen the petitioners selling the liquor.

Patna High Court Cr.Misc. No.5216 of 2018 (2) dt.05-02-2018 2/2 Recovery was made by the side of the road.

Considering the facts and circumstances, let the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each in connection with Udwantnagar P.S. Case No. 341 of 2017 to the satisfaction of the learned 4th Additional District Judge, Bhojpur (Ara) or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
