JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This application, for grant of anticipatory bail, arises out of Jalalpur P.S. Case No. 33 of 2019, disclosing offences under Sections 341, 323, 324, 380, 394, 384 and 34 of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons entered inside the house of informant and subjected them to assault.

Submission of learned counsel for the petitioners is that earlier one Sukeshwar Sharma was murdered, in which, informant's husband was made accused and only to put pressure

Patna High Court CR. MISC. No.86630 of 2019(2) dt.22-01-2020 2/2 on the petitioners, who are relatives of Sukeshwar Sharma, present false case has been lodged and no such allegation as alleged by the informant has ever taken place and further no specific allegation has been attributed to the petitinoers. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -IX, Chapra, Saran in connection with Jalalpur P.S. Case No. 33 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
