2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/120B and other allied sections of the Indian Penal Code.

3. As per the prosecution case, police recovered mobile phone, Bluetooth devices and other materials near the examination center at the time of commencement of constable recruitment exam from Abhay Kumar and others.

4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the possession of the petitioner. The name of petitioner transpired during course of investigation in confessional statement of co-accused. No incriminating material has been

Patna High Court CR. MISC. No.3183 of 2025(2) dt.15-05-2025 2/2 recovered from the possession of this petitioner. Petitioner claims clean antecedent. Similarly situated co-accused persons have already granted bail by this Court vide order dated 11.05.2023 in Cr. Misc. No. 7577 of 2023 .

5 . Learned counsel for the State opposed the bail petition of the petitioner.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Buxar Town Police Station Case No. 571/2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
