JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Suryapura P.S. Case No.71 of 2019 registered under Sections 363, 366(A), 504 and 506/34 of the Indian Penal Code. The accusation is of kidnapping the victim, the minor daughter of the informant, by Rahul Singh, boarding on the motorcycle bearing Registration No.BR 24X 8993, belonging to Chhotu Paswan, the villager of the informant Vinay Rai. Learned counsel for the petitioner submits that the statement of the victim, the daughter of the informant, was recorded under Section 164 of the Code of Criminal Procedure, in which she stated about her kidnapping by Rahul Singh. In

No.81525 of 2019(4) dt.18-06-2020 2/2 fact, the motorcycle, which was used in the kidnapping of the victim, the daughter of the informant, by Rahul Singh, was given by the petitioner as a gift to his son-in-law, who is younger brother of Chhotu Paswan, and, perhaps, the aforesaid motorcycle was handed over by Chhotu Paswan to Rahul Singh. The petitioner only being the owner of the said motorcycle has falsely been implicated in this case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lal Bihari Paswan, Judicial Magistrate, First Class, Bikramganj, Rohtas, in connection with Suryapura P.S. Case No.71 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
