JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Belaganj P.S. Case No. 302 of 2019, registered under Section 30(A) of the Bihar Excise Act, 2006.

The accusation is that on receiving secret information about carrying of Mahua flour loading in Pickup van at Beladih, the informant along with other police personnel reached there and saw one Pickup van bearing registration no. BR24GA 9604 was parked. On seeing the police party, the persons present there succeeded to flee away taking advantage of darkness. On search, three sacks each containing 50 Kg Mahua flour recovered from the said Pickup van. The local

Patna High Court CR. MISC. No.85020 of 2019(2) dt.11-06-2020 2/2 Choukidar disclosed the name of Bhola Sao, Jitendra Sao and Sonu Kumar engaging in carrying the Mahua flour. Learned counsel for the petitioner submits that petitioner is not named in the FIR rather the same has been lodged against Bhola Sao, Jitendra Sao, Sonu Kumar and driver of the Pickup van but later on, petitioner has implicated in the present case as driver of the Pickup van. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya, in connection with Belaganj P.S. Case No. 302 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
