The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a), 35(a), 38, 41 of Bihar Prohibition and Excise Act, 2016. Petitioner No.2, Rajlal Rai @ Rajlal Ray has already been arrested in this case. Hence, his prayer for anticipatory bail has become infructuous now. There is no direct allegation against petitioner No.1, Vinay Kumar and his name surfaced on the basis of secret enquiry made by the Police. Petitioner No.1, Vinay Kumar has stated on oath that he has got no criminal antecedent. Allegation

Patna High Court Cr.Misc. No.61082 of 2018(2) dt.04-10-2018 2/2 is of involvement of sale and purchase of liquor. Considering the aforesaid facts, let petitioner No.1, Vinay Kumar in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Piyar (Hatha O.P.) Police Station Case No.152 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
