The petitioner apprehends his arrest in connection with Ram Krishna Nagar P.S. Case No. 14 of 2018, registered under Sections 363 and 366 of the Indian Penal Code. Petitioner is said to have kidnapped the married daughter of the informant.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner is quite innocent. He has been falsely implicated in this case. Victim who happens to be major in her statement recorded under Section 164 Cr.P.C. has stated that her parents forcefully got her marriage to some other person but she left her marital
Patna High Court Cr.Misc. No.65980 of 2018(2) dt.21-12-2018 2/2 house and later on she eloped with her paramour petitioner Shivji Kumar and out of her sweet will performed marriage with him. She has not stated about her kidnapping by the petitioner. In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIII, Patna in connection with Ram Krishna Nagar P.S. Case No. 14 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
