2. Petitioner is seeking bail in connection with Akbarpur P.S. Case No. 494 of 2025 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per FIR, 128 liters of country made liquor is said to have been recovered from the two plastic bags which was thrown in an open place.

4. Learned counsel for the petitioner submits that petitioner is owner of the motorcycle bearing Registration No. BR-27WO-7443, while the recovery is said to have been made from an open place and the name of the petitioner has transpired in this case merely on the basis of the fact that the petitioner is owner of the motorcycle in question, which is in no way

Patna High Court CR. MISC. No.89040 of 2025(2) dt.24-12-2025 2/2 connected with the seizure. Petitioner is a man of means and there is no chance of tampering with the evidence. It has next been submitted that petitioner has been in judicial custody since 28.11.2025. Lastly it is submitted that the petitioner has no criminal antecedents.

5. Learned APP for the State vehemently opposed the prayer for bail.

6. Regard being had to the submissions made by the parties and taking into consideration the period of custody of the petitioner, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-I, Nawada in connection with Akbarpur P.S.
