JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kashichak P. S. case no. 126/2018 registered under sections 272, 273 of the IPC and sections 30(a) of Bihar Prohibition and Excise Act.

The names of the petitioners came in this case on the basis of confidential information and the informant has himself admitted in his written report that at the time of alleged recovery, no villager was present there. Petitioners do not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

No.76739 of 2018(2) dt.21-12-2018 2/2 well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cum- Special Judge, Nawada in Kashichak P. S. case no. 126/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
