The petitioners are apprehending their arrest in connection with Dandari P.S.Case No.52 of 2018 , registered for offences punishable under Sections 147, 148, 149, 385, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Petitioners altogether 15 in number alleged to have come over the land of the informant and demanded Rangdari of Rs.05 lac and also made blank firing and threatened the informant.
Patna High Court Cr.Misc. No.78066 of 2018(2) dt.04-01-2019 2/2 Submission of the learned counsel for the petitioners is that the land has been settled in their favour and in order to uproot from the possession over the land, the false and concocted case has been lodged and no specific allegation has been attributed against any of them.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Smt. Sweta Grewal, J.M. Ist Class, Begusarai in connection with Dandari P.S.Case No.52 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
