The petitioner seeks regular bail in connection with Minapur P.S. Case No. 510 of 2019, registered for the offence punishable under Sections 414 of the Indian Penal Code, Sections 25(i) (a)/26(3) of the Arms Act and Section 30 of the Bihar Prohibition & Excise Act, Muzaffarpur.

The allegation is regarding recovery of one magazine of a pistol as well as five live cartridges from the waist of the petitioner. It is further alleged that the accused persons, who were arrested, had disclosed about them having stolen a scorpio vehicle for the purposes of committing robbery and upon search, the said vehicle was recovered and four bottles of illicit english liquor was recovered from the said vehicle.

No. 83020 of 2019(2) dt.13-12-2019 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is an accused in one more case relating to Bihar Prohibition and Excise Act, 2016. Lastly, it is submitted that the petitioner is languishing in custody since 19.9.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Minapur Case No. 510 of 2019.
