2. In compliance of order dated 12.02.2025, Investigating Officer of this case is present.

3. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Chakand P.S. Case no. 254 of 2023 instituted for the offence under Sections 323, 341, 324, 354, 504 and 506 of the Indian Penal Code.

4. As per allegation in the FIR, Petitioner came to the house of the informant in drunken position and started to abuse her. On Objection made by the informant, petitioner assaulted her by means of Baretha on her head due to which blood started oozing. When her husband came there to save her, he was also

5. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Both parties are neighbors. It appears from the injury report that injury sustained by the injured Rinku Devi is simple in nature. From perusal of the FIR and case diary it clearly transpires that there is nothing in the case diary as well as FIR itself to attract the case under Section 354 IPC. and rest of the sections are bailable in nature.

6. Learned APP appearing for the State has opposed the prayer of Bail.

7. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Chakand P.S. Case no. 254 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-X, Gaya subject to the conditions as laid down under section 438(2) of the Cr.P.C.
