JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kotwali P.S. Case No. 499 of 2019 for the offenses under Sections 379 and 411 of the Indian Penal Code. Allegation against the petitioner is that he was involved in theft of motorcycle.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 30.10.2019. The seizure list was not prepared in terms of the mandatory provisions of Section 100 Cr.P.C. Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for three months, let the petitioner, above named, be enlarged on bail on furnishing
