JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Supaul P.S. Case No. 330 of 2019 registered for the offences punishable under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation is that petitioner along with others entered inside the house of the informant and there is allegation against co-accused Sandeep Mishra of firing on the son of informant, causing his death.
Submission of learned counsel for the petitioner is that police after investigation submitted final form but learned Magistrate has taken cognizance.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail
Patna High Court CR. MISC. No.82319 of 2019(3) dt.22-01-2020 2/2 stating that there are materials in the case diary showing allegation against the petitioner.
In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 330 of 2019, G.R.No. 905 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation and appear as and when required.
