====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Sahayak Khazanchi P.S. Case No. 146 of 2024 dated 26.07.2024 registered for the offences punishable under Sections 310(2), 311, 111, 249, 238 of the BNS and Sections 25(1-B)a and 26 of the Arms Act.

3. As per the prosecution case, 6-7 unknown miscreants are alleged to have committed dacoity in the Tanishq Showroom and looted jewelleries worth Rs. Three Crore and Seventy Lakhs and a mobile phone on the point of gun.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.6661 of 2025(2) dt.20-02-2025 2/3 present case. The F.I.R. has been lodged against unknown. His name has come in the present case during the course of investigation. The police took the petitioner in custody for further investigation on 07.09.2024 and recorded his confessional statement in which nothing material has been confessed by him with regard to the alleged crime. The petitioner was put on T.I. Parade but the result of the same has never been given to the petitioner or to the court. The police has submitted charge sheet against 12 accused persons including the petitioner. No incriminating has been recovered from his possession. It is further submitted that the other co-accused person Abhimanu Kumar @ Abhimanu Kumar Singh @ Abhimanyou Kr. Singh @ Abhimanyou Kr.

Abhinandan has already been granted bail by a Bench of this Court vide Cr. Misc. No. 86538 of 2024 under order dated 15.02.2025. The petitioner had one criminal antecedent in which he was acquitted by the learned court below as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 08.09.2024.

5. Learned A.P.P. for the State has opposed the prayer for bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.6661 of 2025(2) dt.20-02-2025 3/3 the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IX, Purnea in connection with Sahayak Khazanchi P.S. Case No. 146 of 2024.

7. The application stands allowed.
