====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 02-05-2025 Heard Mr. Dhirendra Kumar Jha, learned counsel appearing on behalf of the petitioner and Mr. Ashok Kumar Singh, learned A.P.P. for the State.

2. Petitioner has sought modification of order dated 18.04.2024 passed in Cr. Misc. No. 13748 of 2024, by which, petitioner was granted provisional bail considering the willingness of the parties to settle the dispute amicably in respect of amount of Rs. 8,97,070/-, which was transferred by the informant into the account of the petitioner. The petitioner has filed application before the learned A.C.J.M.-IX, Darbhanga.

3. Both the parties are present today and have informed that mediation failed.

4. I find that in view of bar under Section 403 of the B.N.S.S., 2023, which is corresponding to Section 362 of the Cr.P.C., the modification application to modify the order dated 18.04.2024 passed in Cr. Misc. No. 13748 of 2024 is not maintainable.

5. Accordingly, the present modification application stands disposed of.
