The petitioner is languishing in custody since 15.11.2019 in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 38 and 41of Bihar Prohibition and Excise Act, 2016.

It is alleged that from the house of the petitioner, 468.600 litres of Indian Made Foreign Liquor was recovered. It is submitted by learned counsel for the petitioner that the recovery has been made from joint family house of the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Considering the fact that the recovery has been made from joint family house of the petitioner and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cumSpecial Judge, Excise, Saran in connection with Janta Bazaar P.S. Case No. 129 of 2019.
