The petitioner is in custody since 25.06.2017 in connection with Sarairranjan P.S. Case No. 11 of 2017 for the offence registered under Sections 414 of the Indian Penal Code and Section 25(1-b)A, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that the alleged recovery of arms is not form his conscious possession and the petitioner has not been arrested from the Scorpio and, therefore, the case under Section 414 of the Indian Penal Code would not be made out as against him. It is further submitted that on the statement of two other persons, who were arrested from the Scorpio, the petitioner, who is said to have fled away, has been

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, Samastipur in connection with Sarairranjan P.S. Case No. 11 of 2017.
