The petitioner seeks regular bail in connection with Punpun P.S. Case No. 376 of 2017 for the offences punishable under Sections 394, 302, 34 of the Indian Penal Code and section 27 of Arms Act.

The allegation is regarding unknown accused persons having killed the deceased.

The learned senior counsel for the petitioner has submitted that no material whatsoever has come during the course of investigation by the police to show the complicity of the petitioner in the present case, which is borne out from a bare perusal of the case diary. It is further submitted that the marriage

No.24822 of 2018 (4) dt.05-07-2018 2/2 of the deceased was to take place with the sister of the petitioner and the petitioner therefore has got no role to play in the alleged incident. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 31.01.2018. Per contra, the learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, Patna in connection with Punpun P.S. Case No. 376 of 2017.
