Petitioners apprehend arrest in connection with Chanpatia P.S. Case No. 291 of 2019 registered for the offence punishable under sections 147, 149, 436, 382/120B of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this due to previous enmity. As a matter of fact, the house of the petitioners are situated adjacent to the shop of the
Patna High Court CR. MISC. No.81755 of 2019(4) dt.06-02-2020 2/2 informant and they have been on litigating terms from before. The present first information report was sent to the concerned Magistrate after 11 days of its registration without any explanation for the delay. During investigation, the Investigating Officer has not found any burnt article or any sign of burning at the place of occurrence. For the same occurrence, another FIR was also lodged vide Annexure-2 implicating petitioner nos. 2 & 3.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah in connection with Chanpatia P.S. Case No. 291 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
