JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner in the present case is seeking regular bail in connection with Baikunthpur P.S. Case No. 162 of 2019 registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner, petitioner has not been put on T.I. Parade and the lady from whose possession a mobile phone was recovered has been granted regular bail learned coordinate Bench of this court in Cr. Misc. No. 69323/2019 as also that petitioner is in custody since 14.10.2019 having no criminal antecedent.

Patna High Court CR. MISC. No.82875 of 2019(3) dt.18-03-2020 2/3 Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that the petitioner has not been put on T.I. Parade, he has not been identified by the informant or any other witnesses and the lady from whose possession the mobile phone was recovered has been granted regular bail by the learned coordinate Bench of this court in Cr. Misc. No. 69323/2019, petitioner is in custody in connection with this case since 14.10.2019 and has already been granted bail by learned court below in the connected case being Baikunthpur P.S. Case No. 228/2019, let the above-named petitioner be released on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Baikunthpur P.S. Case No. 162 of 2019, subject to the condition as laid down under Section 437(3) Cr.P.C. as under:

(a) that such person shall attend in accordance
