The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 366(A), 34, 504, 506 of the Indian Penal Code.
Prosecution case in brief is that proesecution victim was stated to have been kidnapped on 26.03.2019. Father of the victim had lodged complaint with P.S., Bikramganj on 29.03.2019 wherein, he stated that petitioner had kidnapped his minor daughter with intention to marry her. FIR, was registered. As per the information so far available victim is stated not to have been recovered.
Learned counsel for the petitioner submits that the petitioner that the victim had herself left her house and she is
Patna High Court CR. MISC. No.87305 of 2019(2) dt.18-02-2020 2/2 having love affair with the petitioner. She is married with the victim and is living with him as his wife. She also crossed the age of 18 years, hence no case is made against the petitioner. The petitioner has got no criminal antecedent. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bikramganj, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 166 of 2019, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
