Petitioner seeks bail in Gopalpur P.S. Case No.91 of 2017 instituted for the offence under Section(s) 363/366(A)/34 Indian Penal Code.
Counsel for the petitioner submits that victim girl in her statement recorded under Section 164 Cr.P.C. has stated that she was having love affair with this petitioner and she has voluntarily established physical relationship with him. Now, the petitioner and the victim have solemnized marriage. Compromise petition has also been filed in the Court below, which is annexed as Annexure-5. Counsel for the petitioner further submits that victim girl is carrying pregnancy after performing marriage. In
Patna High Court Cr.Misc. No.46745 of 2018 (4) dt.04-10-2018 2/2 support of such submission, counsel for the petitioner has annexed the Medical report as Annexure-6.
Petitioner is said to be in custody since 02.05.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Gopalpur P.S. Case No.91 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
