Petitioner seeks bail in Gandhi Maidan P.S. Case No. 183 of 2016 registered for the offence punishable under Sections 394 of the Indian Penal Code.

Informant has alleged that when he was going on rickshaw to board Bibhuti Express, he was intercepted by four unknown miscreants who snatched his Laptop, mobile and cash of Rs. 9800/- after pointing pistol on him.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on suspicion. Nothing has been recovered from the possession of the petitioner. Petitioner has also not been put on TIP. Petitioner

Patna High Court Cr.Misc. No.45685 of 2018(3) dt.27-09-2018 2/2 has got no criminal antecedent and is in custody since 27.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- Patna, in connection with Gandhi Maidan P.S. Case No. 183 of 2016, with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be sufficient to cancel his bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
