JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2019 The petitioner seeks bail in connection with Excise G.R. No. 840 of 2018 arising out of Nawanagar P.S. Case No. 212 of 2018, dated 04.11.2018, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prayer of the petitioner for grant of bail was earlier rejected vide order dated 28.03.2019 passed in Cr. Misc. No. 18767 of 2019, giving a liberty to the petitioner to pray for bail after six months, if there is no substantive progress in the trial.

It has been submitted on behalf of the petitioner that trial has not yet commenced and the petitioner is in

Patna High Court CR. MISC. No.82407 of 2019(2) dt.12-12-2019 2/2 custody since 05.11.2018.

The petitioner is stated to be the driver of the truck from which 2456.050 litres of liquor is said to have been recovered.

However, in deference to the observation made by a Bench of this Court on 28.03.2019 and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions JudgeCum-Special Judge, Excise, Buxar in connection with Excise G.R. No. 840 of 2018 arising out of Nawanagar P.S. Case No. 212 of 2018.

The application stands allowed.
