The petitioner seeks bail in Sitamarhi P.S. Case No. 394 of 2018 registered for the offence punishable under Sections 275, 276, 419, 420 and 120B of the Indian Penal Code Informant who is Drug Inspector in his written report has stated that on conducting raid in a godown, large number of different medicines and expired medicines were seized and the petitioner was present there who could not produce any license as dealer of the said medicine.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has a valid license for running the medical shop. Similarly, situated co-accused person has been granted bail by a
Patna High Court Cr.Misc. No.34518 of 2018(4) dt.14-08-2018 2/2 co-ordinate bench of this Court vide order dated 12.07.2018 passed in Criminal Miscellaneous No. 34167 of 2018. Petitioner has got no criminal antecedent and is in custody since 16.04.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Drugs & Cosmetics Act), Sitamarhi, in connection with Sitamarhi P.S.
