2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Bahadurpur P.S. Case No. 184 of 2022 registered for the offence punishable under Sections Sections 363, 366A 376(1), 376(2)(N), 376(3) and 506 of the Indian Penal Code and Section 4, 8 and 12 of the POCSO Act.
3. Earlier the bail application of the petitioner has been rejected vide order dated 24.01.2024 passed in Cr. Misc. No. 77147 of 2023, which reads as follows:

2. The petitioner seeks regular bail in a case registered for the offence under Sections 363, 366A 376(1), 376(2)(N), 376(3) and 506 of the Indian Penal Code and Section 4, 8 and 12 of the POCSO Act.
3. As per the prosecution case, a 14 year girl was mislead by the petitioner who is 30 years old and she was taken to Mumbai and sexually assaulted by the petitioner.
4. The Victim girl in her detailed statement recorded under Section 164 of the Cr.P.C. has mentioned the misdeeds of the petitioner who used to sexually assault the victim, physically assault the victim and after she came back to Bihar, he used to threaten her and send her photographs which he had taken of her.
5. Considering the allegation levelled against the petitioner and the fact that victim is a 14 year old minor girl, I am not inclined to grant bail to the petitioner. This application for regular bail is dismissed.
6. The Court below is directed to expedite the trial of the petitioner/s."
4. In the trial, out of five witnesses, three witnesses have also been examined.
5. Considering the gravity of the offence and the fact that the trial is on the verge of conclusion, I am not inclined to grant bail to the petitioner.
