The petitioner, who is in custody, seeks bail in connection with Mirganj P.S. Case No. 149 of 2016 registered for the offence punishable under Section 392 of the Indian Penal Code.

Informant in his written complaint has alleged that on 10.06.2016 four unknown miscreants looted his Bolero Vehicle on point of knife and also snatched his mobile. It has been submitted on behalf of the petitioner that he is not named in the FIR. His name has surfaced in this case on the basis of confessional statement of co-accused Abbas Ansari and Binod Yadav. It has been further submitted that one

Patna High Court Cr.Misc. No.23581 of 2018(5) dt.04-09-2018 2/2 co-accused, namely Abbas Ansari @ Abbash Ansari has been granted bail by a co-ordinate Bench of this Court vide order dated 07.08.2018 passed in Cr. Misc. No. 32722 of 2018. Petitioner is in custody since 13.06.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 149 of 2016.
