The petitioner seeks bail in connection with Ekma P.S. Case No. 325 of 2024 instituted for the offence under Sections 109 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

Prosecution case in short is that on 10.09.2024, the informant was attacked by two miscreants on a motorcycle, one of whom fired at him but he narrowly escaped, and the attackers fled towards Manjhi.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04-10-2024. Petitioner

Patna High Court CR. MISC. No.90303 of 2024(3) dt.27-03-2025 2/3 bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of coaccused, namely, Pankaj Kumar Singh @ Chochawa. There is no specific allegation against the petitioner. Specific allegation is against co-accused, namely, Pankaj Kumar Singh @ Chochawa. He next submits that as is evident from the FIR, informant did not sustain any injury. Charge sheet is submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP submits that co-accused, namely, Pankaj, has confessed that petitioner fled away from spot, though, allegation of firing is against co-accused, Pankaj. Motorcycle which was used by the miscreants is identified by informant in T.I. Parade. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no allegation of firing and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Ekma P.S. Case No. 325 of 2024.
