The petitioner seeks bail in anticipation of his arrest in connection with Tandwan P.S. Case No. 57 of 2019 dated 14.09.2019 instituted for the offences under Sections 406 and 420 of the Indian Penal Code. The petitioner is alleged to have conspired with the Bank authorities and he withdrew the amount deposited by the informant and his son in their bank accounts which was received by them under a Welfare Scheme meant for the benefit of SC/ST community. Learned counsel for the petitioner has submitted that in fact the informant was given that money in expectation of the assistance to be given by
Patna High Court CR. MISC. No.86988 of 2019(3) dt.23-06-2020 2/2 the Government. However, later the informant and his son conspired to falsely implicate the petitioner and appropriate the money which had been given to them by the Welfare Committee.
Regard being had to the vague nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VIII, Aurangabad in connection with Tandwan P.S. Case No. 57 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
