2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Narpatganj P.S. Case No. 762 of 2023 instituted for the offence under Section 392 of the Indian Penal Code.

3. The case of the prosecution, in short, is that the informant is Assistant Manger of I.C.I.C.I. Bank, Araria. On the date of occurrence, he was going to village Mirdaul on his bike and he was carrying a bag which contain cash and certain documents. It is alleged that three persons on a bike surrounded him and on gun point, snatched his bag and mobile. The bag contained ATM Card, Pan Card, Aadhar Card and other documents and cash of Rs. 1,000/-.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The F.I.R. was lodged against unknown miscreants. During the course of investigation, one Vikash Kumar was apprehended and he has given his confessional statement. The name of this petitioner has surfaced in the confessional of coaccused Vikash Kumar. It has further been submitted that nothing has been recovered from the possession of this petitioner. He is having no criminal antecedent. It has also been submitted that similarly situated co-accused person has been granted anticipatory bail by this Court vide Cr. Misc.No. 82751 of 2024. The case of this petitioner stands on similar footing. 5.Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Narpatganj P.S. Case No. 762 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-
