Petitioner, who is in custody, seeks bail in connection with Sitamarhi P.S. Case No. 607 of 2018 registered for the offences punishable under Sections 341, 324, 307, 504 and 506 of the Indian Penal Code.

Informant alleged that when she was going with his brother to his sister house, petitioner (husband) caught hold on her and stabbed on her neck as a result of which she sustained injury in his right neck and thereafter he fled away. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. He is mentally sick and due to unsound mind he assaulted the informant (wife). Informant was

Patna High Court Cr.Misc. No.62920 of 2018(3) dt.26-11-2018 2/2 provided treatment by his family members. He has no criminal antecedent and he is in custody since 19.06.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 607 of 2018.
