The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 21.375 litres of illegal wine has been recovered near the house of the co-accused. He submits that petitioner bears no criminal antecedent as stated in para-3 of the bail petition and he is languishing in custody since 21.11.2019.

In the facts and circumstances of the case, on deposit of Rs. 2,000/- in the Juvenile Justice Fund of the State Social Welfare Department, let the petitioner, above named, be released
