The petitioner seeks regular bail in connection with Tarari P.S. Case No. 92 of 2018 (G.R.No. 3207 / 2018), registered for the offence punishable under Sections 504, 341 and 506 of the Indian Penal Code and Section 25(1-B) a of the Arms Act.

The allegation according to the informant is that the petitioner had come to the doorstep of his house where he was sitting along with his family and had entered into an altercation with the informant whereafter he had taken out a country made pistol and threatened to kill the informant. The informant is stated to have then called the police and lodged the present case.

The learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.64834 of 2018(3) dt.11-12-2018 2/2 that the petitioner is having a clean antecedent and he has been falsely implicated in the present case.

This Court had earlier called for the case diary and the seizure list is contained in Paragraph No. 6 of the case diary wherein there is mention of seizure of one country made pistol from the possession of the petitioner herein. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for grant of regular bail to the petitioner immediately upon completion of six months from the date of arrest i.e. from 16.07.2018, subject to such conditions as may be imposed by the learned trial court i.e. the learned court of Additional Chief Judicial Magistrate, IX, Ara in connection with Tarari P.S. Case No. 92 of 2018. The petition stands disposed of on the aforesaid terms.
