The petitioner is accused in connection with Bakhri P.S. Case No. 286 of 2019, registered under Section 414 of the Indian Penal Code.

The accusation is that in course of patrolling duty, informant received information about moving of Haribol Tanti (petitioner), accused of Bakhri P.S. Case No. 240 of 2019, with looted motorcycle. Thereafter, informant and other police personnel proceeded towards Ambedkar Chouck then saw one person boarding on motorcycle was coming then informant gave signal to stop the motorcycle but he started to flee away, but on chased, he was apprehend, who disclosed his name as Haribol

Patna High Court CR. MISC. No.81920 of 2019(2) dt.16-01-2020 2/2 Tanti (petitioner). Thereafter, on demand, he did not produce the owner book regarding the said motorcycle and did not give satisfactory reply.

Learned counsel for the petitioner submits that, in fact, petitioner was accused in Bakhri P.S. Case No. 240 of 2019, in which, he is on bail, due to that reason he has been implicated in the present case mere on suspicion. Further submission is that in the present case petitioner is in custody since 12.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bakhri P.S. Case No. 286 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
